Acceptance of Terms
By downloading, installing, or using the Vulcan mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service
Vulcan is a mobile application designed for tracking custom motorcycle build projects. The App allows you to:
- Create and manage build projects for custom motorcycles
- Track costs including parts and labour
- Upload and organize build progress photos
- Use voice-to-text input for quick data entry
- Generate customer portal preview links
- Access a directory of motorcycle builders (mock/demonstration data)
- Manage build schedules with start dates and deadlines
User Accounts and Subscriptions
Free Trial
14-Day Trial Period
- Automatically starts on first app launch
- Full access to all features during trial
- No credit card required to start trial
- Trial timer starts from first app open
- After 14 days, converts to read-only mode unless you subscribe
Read-Only Mode (After Trial)
- View existing builds, photos, and data
- Cannot create new builds
- Cannot edit existing content
- Cannot use voice input
- Cannot add photos, parts, or labour costs
Subscription Tiers
Solo Builder - $14.99/month or $149/year
- 1 active build at a time
- Full access to all core features:
- Build creation and editing
- Photo timeline with camera integration
- Voice-to-text input for tasks, parts, and labour
- Cost tracking (parts and labour)
- Task management
- Document management
- Customer information storage
- Build progress tracking
Pro Shop - $39.99/month or $399/year
- Unlimited builds
- All Solo Builder features plus:
- Customer portal preview links
- Invoice generation
- Priority support
- Builder directory profile (future feature)
Annual Savings: Save 17% with yearly billing on any plan.
Billing and Subscription Management
Payment Processing
- All payments processed through Apple App Store
- Charged to your Apple Account at confirmation of purchase
- Prices shown in your local currency
- Prices may vary by country
Auto-Renewal
- Subscriptions automatically renew unless canceled
- Account charged 24 hours before current period ends
- Renewal rate is the same as initial subscription price (unless price changed with notice)
Managing Subscriptions
You can manage and cancel subscriptions at any time through:
- iOS Settings > Your Name > Subscriptions > Vulcan
- Or via the App Store app
Cancellation
- Cancel anytime - no cancellation fees
- Must cancel at least 24 hours before renewal to avoid being charged
- Access continues until end of current billing period
- After cancellation, you’ll have read-only access on the free tier
Changes to Subscription Prices
- We may change subscription prices with 30 days advance notice
- Price changes apply to new subscriptions and renewals
- Existing subscribers notified via email or in-app message
- If you don’t agree with new pricing, you may cancel before renewal
Refund Policy
Apple Processes All Refunds
Since subscriptions are processed through the Apple App Store:
- All refund requests must be made through Apple
- We cannot process refunds directly
- Refunds are at Apple’s sole discretion
- Generally available within 14 days of purchase if unused
How to Request a Refund:

- Sign in with your Apple ID
- Find your Vulcan purchase
- Click “Report a Problem”
- Select “Request a refund”
- Follow Apple’s instructions
Our Refund Policy:
- We honor all refunds approved by Apple
- No refunds for unused portions of subscription periods
- No refunds for early cancellation
- Special circumstances: Contact paul@builtbyomnia.com - we’ll work with Apple on your behalf
User Responsibilities and Acceptable Use
You Agree To:
Use Lawfully
- Use the App only for lawful purposes
- Comply with all applicable laws and regulations
- Not use the App for any illegal activities
Provide Accurate Information
- Enter accurate customer information
- Maintain accurate build data for your records
- Update information when it changes
Respect Others
- Not use the App to harass, abuse, or harm others
- Not upload offensive, illegal, or inappropriate content
- Not impersonate others or create fake customer profiles
Protect Your Account
- Keep your device secure with passcode/Face ID
- Not share your subscription with others
- Notify us if you suspect unauthorized use
You Agree NOT To:
Reverse Engineer or Copy
- Decompile, reverse engineer, or disassemble the App
- Copy, modify, or create derivative works
- Remove or alter any copyright notices or trademarks
Circumvent Restrictions
- Attempt to bypass subscription requirements
- Use VPNs or other methods to manipulate pricing
- Share one subscription across multiple devices/users (family sharing excluded)
Automated Tools
- Use bots, scrapers, or automated tools with the App
- Attempt to overwhelm our systems or APIs
- Extract data programmatically
Malicious Activity
- Upload viruses, malware, or harmful code
- Attempt to gain unauthorized access to systems
- Interfere with other users’ experience
Violation of Intellectual Property
- Upload photos you don’t own or have rights to use
- Use the App to infringe on others’ copyrights or trademarks
Content Ownership and Licenses
Your Content - You Own It
You Retain Full Ownership of:
- Build data, notes, descriptions, tasks
- Photos you upload or capture
- Customer information you enter
- Cost data and financial records
- All content you create in the App
By using the App, you grant us a limited license to:
- Store your content locally on your device
- Process your content to provide App functionality
- Transmit voice recordings to OpenAI for transcription (immediately deleted)
- Display your content within the App interface
We will NOT:
- Claim ownership of your content
- Use your content for marketing without permission
- Share your photos with third parties
- Access your build data (stored locally only)
Our Content - We Own It
We own all rights to:
- App design, code, and functionality
- Vulcan name, logo, and trademarks
- User interface and user experience design
- Builder directory data (mock/demonstration)
- App documentation and help content
You May NOT:
- Copy our code or design
- Use our trademarks or branding
- Redistribute or resell the App
- Create competing products using our intellectual property
When you use the voice input feature:
- You hold the microphone button and speak
- Audio is recorded on your device
- Audio is sent to OpenAI’s Whisper API for transcription
- Transcribed text is returned to the App
- Audio is immediately deleted - not stored on our servers or your device
Important Limitations
Accuracy Not Guaranteed
- Transcription accuracy depends on audio quality, accent, background noise
- You are responsible for reviewing transcribed text for accuracy
- We are not liable for transcription errors
Language Support
- Primarily supports English
- Other languages may work but with reduced accuracy
Data Processing
- Voice data processed by OpenAI (US-based servers)
- Subject to OpenAI’s terms and privacy policy

You Agree To:
- Review transcribed text before saving
- Not rely solely on voice input for critical data
- Understand that voice data is sent to third-party (OpenAI)
Customer Portals
Portal Feature Explanation
The “customer portal” feature generates a preview link that:
- Shows what a customer-facing portal would look like
- Displays build progress, photos, and timeline
- Is generated locally on your device
- Is NOT an actual hosted web portal
Important Limitations:
- Portal links are demonstration/preview only
- We do not host actual customer portals (no backend)
- Links are not shareable in production (local only)
- Future versions may include real hosted portals
Your Responsibility:
- Understand portal feature is preview/demonstration
- Not mislead customers about portal functionality
- Use portal feature for planning/visualization only
Builder Directory
Directory Content
The builder directory contains:
- Mock/demonstration data for educational purposes
- Sample builder profiles to show what’s possible
- Example contact information (not real)
- Future versions may include real builder submissions
We Are NOT Responsible For:
- Accuracy of builder information (currently mock data)
- Quality of builders’ work or services
- Disputes between users and builders
- Transactions or agreements made through the directory
- Fraud or misrepresentation by builders
Using the Directory:
- Understand data is for demonstration purposes
- Verify all builder information independently
- Exercise caution in any business relationships
- Do not rely on directory data for critical decisions
Data and Privacy
Your use of the App is also governed by our Privacy Policy.
Key Privacy Points:
- Build data stored locally on your device only
- We do NOT back up your data to cloud servers
- You are responsible for backing up your device
- Voice recordings sent to OpenAI, immediately deleted
- Subscription data managed by RevenueCat and Apple

Disclaimers and Limitations
“AS IS” Service
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability: App is suitable for general use
- Fitness for a particular purpose: App meets your specific needs
- Non-infringement: App doesn’t violate third-party rights
- Accuracy or reliability: Data is accurate and complete
- Uninterrupted or error-free service: App will always work perfectly
No Guarantees
We do NOT guarantee that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- Results from using the App will be accurate or reliable
- Defects or bugs will be corrected
- The App is free from viruses or harmful components
Data Loss Risk
IMPORTANT - BACK UP YOUR DATA
We are NOT responsible for:
- Data loss due to device failure, loss, theft, or damage
- Data corruption during iOS updates
- Accidental deletion of builds or photos
- Data loss when uninstalling the App
- Data loss due to device storage issues
You must back up your device regularly through:
- iCloud Backup
- iTunes/Finder backup
- Or other backup method
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We Are NOT Liable For:
Indirect or Consequential Damages
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Business interruption
- Lost savings or opportunities
- Indirect, incidental, special, or consequential damages
Maximum Liability
Our total liability to you for any claims arising from the App shall not exceed the amount you paid us in the 12 months prior to the claim.
If you paid $0 (free tier), our maximum liability is $0.
This Applies Even If:
- We’ve been advised of the possibility of such damages
- A remedy fails of its essential purpose
- The damages were reasonably foreseeable
Exclusions
This limitation does NOT apply to:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by law
Indemnification
You agree to indemnify, defend, and hold harmless Paul Vosloo, Built by Omnia, and our affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit or share through the App
- Your interactions with other users or builders
- Any false or misleading information you provide

We are NOT responsible for:

- Actions or omissions of third-party providers
Termination
Termination by You
You may terminate your use of the App at any time by:
- Uninstalling the App from your device
- Canceling your subscription through iOS Settings
- Contacting us at paul@builtbyomnia.com to request account deletion
Effect of Termination:
- Subscription access ends at end of current billing period
- Data stored locally remains on device until App is uninstalled
- No refunds for unused subscription time
Termination by Us
We reserve the right to suspend or terminate your access if you:
- Violate these Terms
- Use the App for illegal purposes
- Engage in fraudulent activity
- Abuse our support or systems
- Harm other users
- Repeatedly infringe on intellectual property rights
Effect of Termination:
- Immediate loss of App access
- Subscription may be canceled (no refund)
- Data remains on your device but inaccessible through App
- We may delete your subscription data
Notice:
We’ll provide notice of termination when possible, but may terminate immediately for serious violations.
Changes to These Terms
We may update these Terms at any time to reflect:
- Changes in our business practices
- Changes in applicable laws
- New features or services
- User feedback
- Legal or security reasons
How We’ll Notify You
When we make changes:
- Update the “Last Updated” date at the top
- Post new Terms in-app and at our Terms URL
- For material changes, provide prominent in-app notice or email notification
Important: Continued use of the App after changes = acceptance of new Terms.
If you don’t agree with changes:
- Stop using the App
- Cancel your subscription
- Uninstall the App

Dispute Resolution
Governing Law
These Terms are governed by the laws of South Africa (update if different), without regard to conflict of law principles.
Before initiating any legal action, you agree to:

- Provide detailed description of the dispute
- Allow us 30 days to attempt informal resolution
We’ll work in good faith to resolve disputes amicably.
Arbitration (If Applicable)

General Provisions
Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App, superseding any prior agreements.
Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect. Invalid provisions will be modified to achieve the intent to the extent possible.
No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right. Waiver must be in writing and signed by us.
Assignment
You may NOT assign or transfer these Terms or your rights. We may assign these Terms to any successor, affiliate, or acquirer without notice.
Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including:
- Natural disasters
- Pandemics or health emergencies
- Wars or terrorism
- Government actions or regulations
- Internet or telecommunications failures
- Third-party service outages
Survival
Provisions that by nature should survive termination will survive, including:
- Ownership provisions
- Disclaimers
- Limitations of liability
- Indemnification
- Dispute resolution
Language
These Terms are written in English. Any translations are for convenience only. In case of conflict, the English version prevails.

App Store Compliance
Subscription Disclosure (Required by Apple):
- Payment will be charged to your Apple Account at confirmation of purchase
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage subscriptions and turn off auto-renewal in Account Settings after purchase
- Any unused portion of a free trial period will be forfeited when you purchase a subscription
